Anthony J. Patek is an experienced litigator who has successfully represented clients in some of the largest patent enforcement actions in the United States. He represented Ronald A. Katz Technology Licensing, Inc. and Zenith Electronics in their efforts to enforce their patent portfolios against numerous infringers. He has also represented major pharmaceutical and software companies and prestigious research universities in multi-million dollar patent litigation lawsuits.

Anthony is also a registered patent attorney who has prosecuted biotechnology, diagnostic, and pharmaceutical patents on behalf of biotechnology companies and research institutions. Prior to practicing law, Anthony performed drug development consulting for major biotechnology companies such as Genentech, Chiron, and Biogen.

Anthony is Co-Chair of the American Bar Association’s Sub-Committee on Patent Infringement. He previously served as Co-Chair of the American Bar Association’s Sub-Committee on Non-Practicing Entity Litigation and Lead Coordinator of the ABA’s Report and Resolutions on En Banc Review of Joint/Divided Infringement in Akamai Technologies, Inc. v. Limelight Network s, Inc. and McKesson Technologies, Inc. v. Epic Systems Corp.

Representative Cases:

  • Monolithic Systems Technology Corp. (MoSys) v. Synopsys, Inc. (Del. Chancery) – Achieved midtrial settlement on terms extremely favorable to client in billion dollar breach of contract case.
  • In re Ronald A. Katz Technology Licensing (S.D. Cal.) – Successfully obtained millions of dollars in settlements from dozens of companies that were infringing inventor’s automated telephony patents.
  • The Board of Regents of Leland Stanford Jr. University et al. v. Roche Molecular Systems et al. (N.D. Cal.) – Represented university and inventors in case involving quantitative PCR technology that ultimately went to the United States Supreme Court.
  • Biogen IDEC, Inc. v. GlaxoSmithKline, University of Michigan, Coulter Pharmaceuticals, Inc., and Corixa Corporation (S.D. Cal.) – Represented radiolabeled antibody manufacturer in patent infringement cross-claim, obtaining a summary judgment that led to multimillion dollar settlement in client’s favor.
