Overview

Why You Should Attend

This program is designed to provide attorneys with an understanding of the lawyer’s ethical duties that arise in the course of discovery, including e-discovery.  Whether you are new to your career or an experienced attorney, the program will help you analyze your obligations under relevant rules of professional conduct when engaging in the discovery process.

  • Select ethical obligations impacting discovery, including protecting confidential information
  • Navigating the discovery process in light of ethical obligations
    • Apportionment of responsibility as between in-house counsel and outside counsel and IT
    • Breach notifications
  • Attorney ethical responsibilities and best practices for preservation, collection, technology-assisted review (“TAR”), and production of electronic documents
  • E-discovery and data security: Particular ethical challenges
  • Cloud (Clarifying Lawful Overseas Use of Data) Act and ethical implications
  • European General Data Protection Regulation (GDPR) compliance and ethical implications

Who Should Attend

The program will help litigators and in-house counsel who have litigation responsibilities understand how to act ethically when navigating the discovery process.

Program Level: Basic

Intended Audience: Outside attorneys, in-house counsel, and other allied professionals involved in litigation and document collection, preservation, review and/or production.

Prerequisites: A familiarity with the professional responsibilities of lawyers, rules of professional conduct, civil practice and procedure rules, and a background in litigation, document collection, preservation, review and/or production.
