Overview

By now, everyone is familiar with the economic and social harm caused by patent monetization entities: billions of dollars lost, drastically reduced R&D spending, less venture capital inflow; the list is lengthy and the evidence grows each year.  What is less discussed is the role the defense firm plays in the NPE’s ability to secure nuisance settlement after nuisance settlement; as long as it costs a fortune in legal fees to fight NPEs, NPEs will continue to thrive.

Thus, lawyers need to learn to successfully defend entities against NPEs in a way that is affordable and effective, in a way that reduces the classic asymmetries that favor NPEs: 1) cost, 2) risk, and 3) business disruption.

Rachael D. Lamkin founded a first of its kind law firm that solely practices NPE defense litigation and she has been incredibly successful in her aim.  Through this presentation, you will learn the strategies she employs to defeat NPEs:

  • Combating NPEs as NPEs (not product-producing companies);
  • The five categories of NPEs and how to respond to each;
  • Lessons from recent victories against each category of NPEs;
  • How to align your thinking to the client's goals;
  • Key leverage points for upending the three asymmetries;
  • Risk sharing with the client;
  • Discovery in an NPE litigation; and
  • Triggering attorney’s fees where possible.
