At this year’s program we will look at two important issues confronting attorneys today: conflicts of interest, and risk issues for inside counsel.
  • Navigating the Minefield: How to Identify, Avoid and Address Conflicts of Interest. When participating in an adversary system, it is important to distinguish between friend and foe. As the size of law firms continues to accelerate, the frequency with which conflicts of interest are encountered accelerates even faster. This first hour of the program will provide an overview of how conflicts of interest arise, how to ensure they are identified, and how they can be avoided or addressed. It will also include a discussion of recent cases highlighting the difficulty lawyers face if conflicts of interest are not timely identified and handled.
  •  Current Risk Issues for Inside Counsel: When Bad Things Happen to Great Law Departments. To paraphrase Edmund Burke, those who don’t know current events are doomed to be embarrassed. This second hour of the program looks at a number of well-respected corporate lawyers and legal departments, who recently have found themselves in civil, criminal, and ethical peril. While some of these stories have generated media attention, many have been surprisingly under-reported. We will review the allegations in each of these matters, and explore both what these claims mean for corporate law departments as well as how similar risks can be better managed in the future.
