Overview

The United States Patent and Trademark Office (USPTO) began accepting applications under The Hague Agreement on May 13, 2015. Under The Hague Agreement, U.S. applicants may now apply for design protection in more than 60 jurisdictions by filing a single International Design Application (IDA) in English with the USPTO. 

However, filing an IDA under The Hague Agreement is not something to attempt without some significant planning up front.  The lack of a universal drawing standard for example mandates that U.S. patent practitioners understand the nuances of the desired jurisdictions before they file their IDA. 

Speakers Tracy-Gene G. Durkin of Sterne, Kessler, Goldstein & Fox P.L.L.C. and David R. Gerk of the United States Patent and Trademark Office will: 

  • Provide an update on the changes to U.S. Design Patent practice since the USPTO instituted rules implementing the Hague Agreement;
  • Discuss the benefits and drawbacks of the Hague System; and
  • Offer best practices for filing International Design Applications.
