Overview

A recent California district court held that a school district’s genuine belief that a school student with genetic markers for cystic fibrosis posed a significant health risk to two siblings diagnosed with the disorder justified its decision to temporarily remove the student from school. See Chadam v. Palo Alto Unified School District (4:13-CV-04129-CW). The U.S. District Court, Northern District of California granted the district's motion to dismiss the parents' Section 504 and ADA Title II claims. The case has now been appealed to the 9th Circuit and has introduced a new area of discrimination claims based upon genetic markers and potential legal issues for school districts and private  schools alike.
