Overview

The European Court of Justice (“ECJ”) has invalidated the E.U.-U.S. data protection safe harbor (the "Safe Harbor"), finding that the Safe Harbor failed to adequately protect personal data transferred from the E.U. to the U.S. as required under the E.U. Data Protection Directive 95/46/EC.  In the wake of this landmark decision, businesses can no longer rely on the Safe Harbor to transfer data from the E.U. to the U.S.
