Overview

Why You Should Attend

Psychological issues in employment law are both unavoidable and fascinating.  They help to determine counsels’ day-to-day advice regarding a variety of employment issues, and play a central role in preventing, pursuing and resolving litigation.  With the continued increase in mental disability accommodation requests and discrimination charges, attorneys and mental health professionals frequently work together.  Yet attorneys and mental health professionals struggle to communicate effectively and often are on opposite sides of disputes.   

This program brings together prominent practitioners from the management and plaintiffs’ bars, the Equal Employment Opportunity Commission, in-house counsel, and forensic psychiatrists and psychologists, to transcend the jargon, identify practical ways of working together, and to describe effective strategies to avoid, pursue and resolve litigation.  They will address in a clear and pragmatic way key legal and ethical issues at the intersection of employment law and psychology.

• Update from the EEOC, outside and in-house counsel on key mental disability issues under the Americans with Disabilities Act, including accommodations issues and the use of personality tests with job applicants and employees

•Litigation strategies when mental health professionals are involved as treating therapists, experts or consultants

•When and why to conduct a mental examination of an employee-litigant and how to use the results at

deposition and trial

• Ethical issues that arise when lawyers and mental health professionals work together or are adverse in litigation

• Ethical issues that arise when sensitive information about an employee’s or litigant’s psychiatric history and mental health record is at issue
