Overview

Following a shocking decision by the European Court of Justice invalidating the Safe Harbor framework that had served for 15 years as a legal mechanism for transferring EU personal data to the U.S., and after more than two years of negotiations, the European Commission announced on February 29, 2016 a new framework to replace the Safe Harbor.  Known as the EU-U.S. Privacy Shield, this new regime follows the same general format as the Safe Harbor but is far more detailed and contains more stringent requirements.
