Overview

The marijuana industry has been described as the next (Acapulco) Gold Rush. Twenty-three states and the District of Columbia have legalized marijuana in some form.  Colorado, Washington, Alaska, Oregon, and the District of Columbia recently passed laws legalizing recreational use; the remaining states allow consumption for medical purposes.  In 2016, five more states are expected to introduce ballot measures to legalize recreational marijuana, including California, Massachusetts, and Nevada.  A recent Rasmussen poll found 56% of Americans favor legalizing and regulating marijuana.  Like same-sex marriage, the tide appears to have turned quickly and decisively against cannabis prohibition, which portends the need for legal advice.  Yet, the possession, sale, and control of marijuana remain federal crimes.  What is an ethical lawyer to do?
