Overview

Cloud computing services, including the use of Software as a Service (SaaS), Platform as a Service (PaaS), and Infrastructure as a Service (IaaS) are becoming standard industry practices and the U.S. export control regimes are not keeping up with these fundamental shifts in remote computing services.  The U.S. federal agencies responsible for most international trade and technology transfer controls are being led by the U.S. Department of Commerce, Bureau of Industry and Security (BIS), which has issued three important Advisory Opinions on the application of the Export Administration Regulations to cloud computing arrangements.  Other agencies have largely remained silent on the application of their regulations to these new arrangements.
