Victoria A. Cundiff

Victoria A. Cundiff is a leader of the litigation department's global trade secrets practice at Paul Hastings. Ms. Cundiff has tried or successfully resolved intellectual property and commercial disputes, including trade secrets, non-competition, "inevitable disclosure," intellectual property ownership, and other complex disputes in state and federal courts throughout the United States and before a variety of arbitration and mediation tribunals. She also advises on such disputes internationally and coordinates multi-jurisdictional litigation. Her clients include some of the world's leading software developers, computer networking companies, executive recruiters, insurance brokerage firms, chemical and manufacturing organizations, and sales and distribution companies. She has been named a "Leading Lawyer" nationally in the trade secrets field by Legal 500 and is consistently named as one of the Top 50 Women Superlawyers in the New York Metropolitan Area.  See www.superlawyers.com for criteria. Ms. Cundiff is also noted for designing confidential investigation procedures and verification protocols for resolving intellectual property use and ownership disputes outside of court. She also assists clients in licensing intellectual property rights and establishing internal controls to protect trade secrets and to conduct lawful competitive intelligence.

Ms. Cundiff is on the Board of Editors of Internet Law & Strategy. She has been part of a team preparing amicus curiae briefs to the United States Supreme Court on behalf of the Intellectual Property Owners Association in Kirtsaeng v. John Wiley & Sons, Inc. (copyright); Stanford University v. Roche Molecular Systems, Inc., --U.S.--, 131 S.Ct. 2188 (2011) (patent licensing); and Costco Wholesale Corp. v. Ms. Cundiff is a Visiting Lecturer in Law at Yale Law School, where she teaches intellectual property law.

Ms. Cundiff is a member of the Executive Committee of the New York State Bar Association's Intellectual Property Section and is the past Chair of that section. She serves as liaison to the New York State Bar Association's Alternative Dispute Resolution Section. She is a member of the Intellectual Property Owners Association's Committee on Trade Secrets. She was an invited civilian guest at the U.S. Army War College National Security Seminar.

Ms. Cundiff received her B.A. degree from the University of Denver (summa cum laude), where she was a Boettcher Foundation Scholar, and her J.D. degree from Yale Law School. She is on the advisory board of the Yale Law School Center for the Study of Corporate Law. She is admitted to practice in New York, Colorado, and the District of Columbia.
