Kenneth Mathieu has over 16 years of experience providing forensic, litigation and valuation services in the United States and abroad. His significant experience encompasses conducting analyses for dispute-related damages involving merger and acquisition disputes, business valuation, accounting disputes and fraudulent conveyances. Mr. Mathieu also conducts complex investigations related to accounting irregularities and management conduct. He has served as both testifying expert and consulting expert in various matters involving complex damage, valuation and accounting issues. Mr. Mathieu has experience in a variety of industries including, manufacturing and distribution, healthcare and professional services.
Mr. Mathieu advises clients in post acquisition disputes related to post closing adjustments, breaches representations and warranties, and earn out calculations involving accounting and valuation issues. His experience in auditing, valuation and damages provide a unique perspective for merger and acquisition related disputes. He has experience serving as the testifying and consulting expert for private equity firms as well as private and public companies in a variety of industries involving transactions valued from $10 million to over $1 billion.
Mr. Mathieu has performed solvency and reasonably equivalent value analysis in the context of the United States Bankruptcy Code to assist the courts in assessing potential fraudulent and preferential transfers. He provides financial advisory services related to business valuation in various situations, including shareholder disputes, marital dissolution, and acquisition and divestiture analysis. In addition, he provides financial analysis and calculates damages related to intellectual property matters, including patent and copyright infringement and theft of trade secrets. Mr. Mathieu has experience calculating lost incremental profits and reasonable royalties as well as the unjust enrichment of an infringer.
Mr. Mathieu has experience providing accounting and financial analysis for various situations, including ability to pay analysis, ERISA matters and unfair competition claims. He has extensive experience leading complex investigations related to accounting irregularities and management conduct. He works with the client to identify and define the issues, assemble the appropriate team to conduct the investigation, develop a work plan, obtain evidence, conduct interviews and report the findings.
Mr. Mathieu has over eight years of experience with Big 4 Accounting firms, and previously served as a managing director at FTI Consulting Forensic and Litigation Consulting practice. He is a Certified Public Accountant, Certified in Financial Forensics and Accredited in Business Valuation. Mr. Mathieu is a past member of the AICPA’s Forensic and Litigation Services Committee and the former chair of the Webinar Task Force. He has taught valuation and damages at numerous venues, including to members of the Chinese Appraisal Society. Mr. Mathieu has published numerous articles, including “Benefit of Bargain Damages,” The Comprehensive Guide to Lost Profits for Experts and Attorneys, in January 2011.
