David L. Marston has been a Partner in the Advisory practice of PricewaterhouseCoopers LLP since 1997. Mr. Marston has been with the Firm since 1990 and has a wide variety of international consulting experience and expertise, with a focus on intellectual property matters, including: maximizing the monetization of IP, licensing compliance issues, contractual license agreement issues, consulting on software asset management, and risk assessments related to IP.
He works primarily in the software and technology sectors, but has also serviced clients in telecom, life science, and branded goods. He spent the period of 1998-2001 on an international assignment in Western Europe (Zurich, Switzerland), and is based in our San Francisco office.
Mr. Marston's experience includes:
- Engagement Partner, working on behalf of one of the world's largest technology companies, leading international royalty examinations. The project is ongoing and includes licensing work in twelve different countries, on over 200 different licensee companies. The examinations included the identification of underreported royalties, unaccounted for product, contractual violations, and internal control improvements.
- Engagement Partner, working on a major global IP dispute with US Licensor. Technology licensee in Taiwan made a claim for a refund of over $60M in previously paid royalties over a 7 year period. Using a forensic and data driven approach, the team was able to reduce the ultimate settlement to less than one-third of the original claim.
- Engagement Partner, working with a major software company to lead world-wide End User SAM inspections. This work is on-going, focusing on potential over deployment of software within an enterprise network, and the calculation of the economic impact of such over deployment. Forensic approach continues to lead to significant findings and settlements.
- Engagement Partner, working with a variety of multinational clients on various intellectual property matters, including infringement disputes, trade secret issues, piracy concerns, grey market investigations, and channel partner reviews.
Mr. Marston has served as a neutral Arbitrator and has assisted in numerous arbitrations related to IP accounting issues. He has testified in both Federal and State Court as an expert witness on a number of occasions.
Mr. Marston received his Bachelors degree, Cum Laude, in Business Administration (Law Minor) from California Polytechnic State University in 1979. He is a Certified Public Accountant (CPA) in the state of California, and a member of the AICPA. He is a certified Licensing Professional (CLP) and Certified in Financial Forensics (AICPA). Mr. Marston has spoken at a number of international conferences on IP compliance issues and has taught several internal courses on the same subject. He is the National Leader of the Firm's Licensing Management & Contract Compliance practice.
