David Gustman is a Partner in the firm's Litigation and Antitrust Practice Groups and serves as a member and former Chairman of the firm's Executive Committee. For more than 30 years Mr. Gustman has handled numerous complex business litigation cases involving antitrust, accounting, banking, bankruptcy, construction, finance, insurance, real estate and securities. He has considerable experience representing clients in class action litigation, counseling clients on antitrust and securities issues, and providing general corporate and strategic advice to the firm's clients. His areas of focus include: antitrust counseling and litigation, appellate law, complex disputes, fiduciary litigation, franchise and dealership law, insurance coverage, securities litigation, and real estate litigation.
He has been selected by the Leading Lawyers Network as a Leading Lawyer in the categories of Antitrust Law, Commercial Litigation, and Corporation Law and was named as an "Illinois Super Lawyer" in the area of Business Litigation. In addition, he is a Fellow of the Litigation Counsel of America. This honor is awarded to attorneys who are among the elite trial and appellate lawyers within their practice areas throughout the United States.
Mr. Gustman provides antitrust counsel to joint ventures, trade associations, research consortiums and companies involved in mergers and acquisitions, as well as those facing antitrust claims. For example, he was lead counsel for one of the defendants in In Re Potash Antitrust Litigation (successfully resolved by summary judgment and affirmed on appeal (1993-1999)) and In Re Sulfuric Acid Antitrust Litigation (final judgment in favor of his clients; currently on appeal to the 7th Circuit Court of Appeals). He has also successfully defended clients in connection with criminal antitrust investigations by the Department of Justice.
He has also served as lead antitrust counsel for a large international company in connection with its merger with a significant competitor. Mr. Gustman represented the company before the U.S. Department of Justice in order to win regulatory approval for the merger, resulting in one of the largest mergers in Canadian history.
Chambers USA lists Freeborn & Peters LLP as a leading Illinois law firm that is "nimble" within the antitrust world, specifically recognizing Mr. Gustman. He was once again selected by The Best Lawyers in America for inclusion in its 2012 edition in the specialty of Antitrust Law and The Legal 500 recognizes Mr. Gustman as a 'Leading Individual' in Antitrust - Midwest for his work with Mergers, Acquisitions and Buyouts. Who's Who Legal International, the Official Research Partner of the International Bar Association, has also identified Mr. Gustman as one of the top twelve Illinois lawyers practicing Antitrust and Competition Law. Mr. Gustman is a frequent speaker and author on various legal topics, including antitrust, class actions and mergers. He has spoken several times at the PLI's Annual Antitrust Law Institute, held at the University of Chicago. He also co-authored a paper entitled Joint Ventures and Other Competitor Collaborations, published by the PLI Law Institute.
